Terms and Conditions
1. Introduction
These Terms and Conditions ("Terms") govern your access and use of the Astep mobile application ("App" or “Services”) provided by Recs AI Limited ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms, our Privacy Policy, and any additional terms. If you do not agree, do not use the App.
The App is primarily for users in Hong Kong but available globally via app stores. You must have legal capacity to agree.
2. Description of Service
Astep is a subscription-based CRM tool for freelancers to track clients, schedule sessions, manage packages, and sync with Apple Calendar or Google Calendar. Features may be updated or discontinued.
3. User Accounts
You must provide accurate information (name, email, phone, profession) to create an account. You are responsible for account security and all activities.
4. User Responsibilities
You agree to:
- Use our Services only for lawful purposes and in compliance with all applicable laws and regulations of Hong Kong and any other jurisdiction in which you use the Services.
- Obtain consents from clients before entering their data.
- Comply with Hong Kong laws, including PDPO.
- Not misuse the App (e.g., no reverse engineering).
5. Payments and Subscriptions
The App operates on a subscription model. Payments are processed securely via Stripe (and through Apple/Google where applicable). Fees are non-refundable except as required by law. We may change pricing with notice.
6. Intellectual Property
Ownership of Our Services: All intellectual property rights in our Services, including software, trademarks, logos, and proprietary content created by us, are owned by Recs AI Limited or licensed to us.
Prohibited Use: You may not copy, reproduce, modify, distribute, or create derivative works of any part of our Services or third-party content accessed through our platform without explicit permission from the respective rights holders.
7. Termination
We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, if we believe you have violated these Terms or engaged in unlawful activities.
8. Disclaimers and Limitations
To the maximum extent permitted by Hong Kong law:
1. Our Services are provided on an "as-is" and "as-available" basis without warranties of any kind.
2. We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services.
9. Indemnification
You indemnify us against claims from your use, including client data issues.
10. Compliance with HKSAR Laws
Our app complies with the laws and regulations of the Hong Kong Special Administrative Region (HKSAR), including but not limited to:
- Copyright Ordinance (Cap. 528): Protects intellectual property rights, including the distribution and use of copyrighted materials.
- Personal Data (Privacy) Ordinance (Cap. 486): Governs the collection, use, and protection of personal data.
Users are also required to comply with these laws when using our Services. Specifically:
1. Copyright Compliance: Users must not share links or content that infringes on the copyrights, trademarks, or intellectual property rights of third-party creators or platforms.
2. Privacy Compliance: Users must not share links to content containing personal or private data of others without their explicit consent.
Violation of these laws may result in suspension or termination of your account, and we reserve the right to report unlawful activities to the relevant authorities.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR). Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of HKSAR.
12. Changes to Terms
Updates will be posted; continued use is acceptance.
